Employers seeking to hire overseas nationals who are not settled workers or lack immigration permission to work in the UK must apply to the Home Office for a sponsor licence. The type of licence required depends on the immigration route of the overseas worker. Note that since 31 December 2020, most EU, EEA, and Swiss nationals need to be sponsored to work in the UK.
What Is a Sponsor Licence?

A sponsor licence allows a UK business to employ workers from outside the UK. This includes both non-EU nationals and most EU, Iceland, Liechtenstein, Norway, and Switzerland citizens who arrived after 31 December 2020. Exceptions include Irish citizens, individuals with settled or pre-settled status under the EU Settlement Scheme, those with indefinite leave to remain, or those with other permissions to work.

Applicants must demonstrate to the Home Office that:

They are honest, dependable, reliable, and have not engaged in activities contrary to the public good.

They are capable of fulfilling sponsor duties and complying with sponsor guidance.
To verify these criteria, you must submit various company-related documents, the specifics of which depend on your organisation type and the sponsorship route.
Route-specific Requirements
Different immigration routes have specific requirements. For example:

Skilled Worker Route: Employers must demonstrate they can offer a job meeting the skill and salary levels required, that the job is genuine, and that there is a direct employer-employee relationship.

UK Expansion Worker Route: Employers must show they can meet skill and salary levels, that the job is genuine, and that there is a qualifying link between the UK and overseas businesses. The overseas business should not already be trading in the UK, but have a UK presence, be active and trading overseas for at least three years, and plan to establish a UK trading presence within two years.
Key Personnel
Before applying, appoint key personnel:

Authorising Officer: A senior individual responsible for the licence.

Key Contact: The primary contact for the Home Office.

Level 1 User: Manages the sponsor licence through the Sponsorship Management System (SMS).
These roles must be filled by individuals in the UK without unspent criminal convictions or adverse history.
Application Steps

Submit relevant supporting documents within five working days.

Provide information about the key personnel and justification for the licence.
A legal representative can assist but the sponsor must submit the application.
Costs and Processing Times

Fees: £536 for small companies or charities, £1,476 for medium or large companies.

Processing Time: Up to 8 weeks. A priority service costing £500 provides a decision within 10 working days.
Duration and Renewal

A sponsor licence is valid for 10 years, with renewal required before expiry. UK Expansion Worker sponsor licences are typically not renewable but can be transitioned to other routes.
Licence Rating and Responsibilities

Approved licences are usually rated ‘A’. UK Expansion Worker sponsor licences may receive a ‘Provisional’ rating. Sponsors must use the SMS to manage their licence, report specific events, and ensure compliance with sponsorship duties to avoid licence revocation.
